I can't bring myself to use the semantic html5 elements just yet - the lack of support in IE without javascript is just too much of a burden.

You should check out this updated version http://new2wp.com/rookie/just-html5-making-a-basic-page-the-right-way/
Also, if you go to the example page, http://new2wp.com/labs/justhtml5/justhtml5.html you can easily view the source and copy the code from there if you want. This post is more of a tutorial on how to do this yourself. It isn't a theme I made so you can download it. It requires more work on your part, sorry.
